Paternity can be important to establish for a child born out of wedlock, in order to prove the right to child custody, visitation or support. This can be just as important for children born during a marriage, as there is a presumption for such children that a husband of the biological mother is the biological father. If a father refuses to sign a voluntary acknowledgment of paternity, a Massachusetts General Laws Chapter 209C paternity petition may need to be filed, temporary support sought where necessary, and motions made to compel genetic-marker testing.

We can also help with defending a paternity claim. Where a father has filed an incorrect acknowledgment of paternity-- this can happen through duress or fraud not on his part, or through simple mistake-- a voluntary acknowledgment of paternity may need to be rescinded, and a capable paternity defense lawyer can be instrumental in this process.
